Welcome to Happy Sack. These Terms of Service ("Terms") are a legal agreement between you and Happy Sack ("we," "us," or "our") and govern your access to and use of the website https://happysack.co and any products you purchase from us (together, the "Services"). By using the Services or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order. By placing an order you represent that you meet this requirement and that the information you provide is true and complete.
You do not need an account to browse Happy Sack, but you do need to provide accurate contact and shipping information at checkout. You are responsible for keeping that information current. We are not responsible for orders that fail to deliver because of incorrect or outdated shipping details.
All current Happy Sack products are sold as pre-orders. This means:
The Pre-Order Promise. If we miss our June 10, 2026 ship date for your order, we will email you with a revised ETA. You may then choose to (a) keep your order at the new ETA or (b) request a full refund to your original payment method. You may also cancel your pre-order for a full refund at any time before it ships. See our Refund Policy for details.
All prices are shown in US dollars and are subject to change before you place your order. Shipping and any applicable sales tax are calculated and shown at checkout. Payment is processed by Stripe; we do not store your full card number on our servers. By placing an order you authorize the charge to your selected payment method for the order total, including any shipping and tax shown at checkout.
If a product is listed with a price that is clearly wrong due to a typographical or system error, we reserve the right to cancel the order and issue a full refund.
We currently ship within the United States. Shipping is handled by a third-party carrier and tracking is provided by email once your order ships. Title and risk of loss pass to you when the carrier accepts the package. If a package is lost or damaged in transit, contact us at info@happysack.co and we will work with you to make it right.
Our complete cancellation, refund, and return policy is set out in our Refund Policy, which is incorporated into these Terms by reference. By placing an order you also agree to the Refund Policy.
Custom and bulk orders (50+ units) are quoted and invoiced separately and are subject to a written order confirmation. Because custom orders are produced specifically for you, deposits paid on custom orders are non-refundable once production begins. Specific custom-order terms will be set out in your quote and invoice and, where they conflict with these Terms, the quote and invoice control.
We do our best to describe and photograph each sack accurately. Because of differences in monitors, lighting, and natural variation in fabric, the exact color, fill, and stitching of the sack you receive may differ slightly from the photos on the Services. Minor variation is part of a handmade product and is not a defect.
You agree not to use the Services to:
The Happy Sack name, logo, smiley designs, "Kick it. Keep it happy." tagline, photography, and all other content on the Services are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may not copy, modify, reproduce, or use any of it for commercial purposes without our prior written permission. Personal, non-commercial use of the Services (browsing, sharing a link with a friend) is fine.
The Services use third-party providers, including but not limited to Stripe (payments), Vercel (hosting), and Cloudflare (DNS and email). Your use of those providers' services through Happy Sack is also subject to their own terms and privacy policies. We are not responsible for the acts or omissions of these third parties.
THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE OR COMPLETE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL HAPPY SACK, ITS OWNERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE PRIOR 12 MONTHS OR (B) US $50.
Some jurisdictions do not allow the limitation of incidental or consequential damages, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Happy Sack and its owners and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally will be brought exclusively in the state or federal courts located in Hampden County, Massachusetts, and you consent to the personal jurisdiction of those courts.
Before filing a claim, you agree to first try to resolve the dispute informally by emailing info@happysack.co and giving us 30 days to respond.
We may update these Terms from time to time. The updated version will be indicated by a revised "Last updated" date at the top. If we make material changes, we will take reasonable steps to notify you (for example, by posting a notice on the Services or, if you have placed an order, by email). Your continued use of the Services after a change becomes effective means you accept the updated Terms.
